MEDICAL MALPRACTICE IS NOW REPORTED  BY THE AMA AS THE THIRD LEADING CAUSE OF DEATH IN AMERICA TODAY!

A recent study published by the American Medical Association shockingly reports that medical malpractice is now the third leading cause of death in America today just behind heart disease and cancer. In 2012, over $3 Billion was reported as payouts due to medical malpractice alone.

Yet, there are efforts underway in Idaho to exonerate healthcare professionals from accepting their responsibility for the bad choices and decisions they make on behalf of their patients.  One way this has been accomplished is by the Idaho Legislature enacting legislation that caps the amount of money that a victim of negligence can receive for their non-economic damages for, inter alia, pain and suffering; diminution in the quality of life and capacity to enjoy life; and/or loss of consortium recoverable by victims of medical malpractice.

In California, the arbitrary cap on non-economic damages is reported in the amount of $250,000.00. In Idaho, the cap on non-economic damages imposed by the Idaho Legislature is limited to the sum of $319,734.34 as of July 1, 2013. The figure is adjusted each year (on July 1).

The reason I am a trial lawyer working as an advocate for justice on behalf of victims of negligence is that I believe that by holding people and institutions accountable for the bad choices and decisions they make gives incentive to reform their conduct which makes our homes and communities a safer and better place to live for our children and grandchildren.

Holding tortfeasors fully and completely responsible for the injuries and damages they cause due to their bad choices and decisions results in reforming conduct to a higher standard of care and a safer living conditions for our families. Exculpating those who perpetrate harm to others who violate the local standard of care takes away that incentive and rewards them for their misconduct resulting in catastrophy as in the case of Annette Ramirez noted in the video above.
