Bus Driver Cited for Inattentive Driving Resulting in Injury to Child

The Idaho State Police report that a bus driver was issued a traffic citation for inattentive driving, a misdemeanor, as a result of a bus accident which occurred Thursday, March 13, 2014 where the driver drove the bus off the road, down an embankment and rolling on its side. The accident occurred on 7 Devil’s Road near Riggins, Idaho. One child, a second grade student, was taken to the hospital and was treated and later released.
Under Idaho law, a claimant seeking damages against a school district (or individual working on its behalf) must file a notice of tort claim against the bus driver, bus company and the school district pursuant to Chapter 9, Title 6, of the Idaho Code. The law requires that the notice be served no later than 180 days from the date of the accident. Failure to file and serve a notice of tort claim could result in the claim being time barred pursuant to statute. In addition to filing a notice of tort claim, a lawsuit must be filed prior to the expiration of the statute of limitations as well.
