Last Sunday morning, a motor vehicle/pedestrian crash occurred on Interstate 84 resulting in the death of 23-yr-old Winters Wareagle of Meridian, Idaho. Wareagle was driving eastbound on the Interstate near the Boise Port of Entry when his car broke down, and he pulled his car off to the side of the road onto the shoulder. As Wareagle was getting out of his car, his car was struck by 28-yr-old Patrick Musgrove of Meridian, Idaho.

Wareagle died at the scene of the collision, and Musgrove was charged with Aggravated DUI and Vehicle Manslaughter.

The Idaho State Police are continuing to investigate this accident and are conducted a collision reconstruction.

A person who is the victim of a drunk drive has only 180 days from the date of loss to serve the purveyor of the alcohol with a notice of dram shop before filing suit. If an establishment has served alcohol to an obviously intoxicated person, then the purveyor of the alcohol may also be jointly responsible for the injuries and damages caused by the obviously intoxicated person.

We at Morton Law Offices, Chartered give our sincerest condolences to the family and friends of Winters Wareagle for his untimely death.
