Posted on Apr 27, 2014
ELMORE COUNTY -- Elmore County Sheriff’s Deputies report that a 2004 Ford Excusion was traveling eastbound on I-84 when the driver lost control and veered off the road on the right shoulder causing the Excursion to roll over several times before stopping on its roof. All 7 occupants (2 adults and 5 children) were taken to the hospital Saturday afternoon shortly after 5:00 p.m. Two occupants were flown to by Life Flight to the St. Alphonsus Regional Medical Center located in Boise, Idaho. St. Alphonsus is a local regional trauma center for the Treasure Valley. Five passengers were taken to the hospital by ground ambulance. One of the adults were reported as not wearing a seat belt when the adult was ejected from the vehicle, however, the failure to wear a seat belt in Idaho is not admissible in a court of law to prove either comparative negligence or failure to mitigate damages. See, e.g., http://www.mortonlawyers.com/faqs/seat-belt-defense.cfm. The other adult had to be extricated from the vehicle due to the severity of the damage to the Excursion.
The accident is currently under investigation.
