If a timely notice is not served that comports with the form and content mandated by the Idaho Tort Claims Act, your claim may be dismissed even if a lawsuit is timely filed.  As such, the law requires that both a notice of tort claim be timely served within 180 days from the date of the accident and, in addition thereto, a lawsuit be timely filed prior to the expiration of the Statute of Limitations.
